Why does your SME need to archive emails?
In Switzerland, Article 958f of the Swiss Code of Obligations requires all companies to retain their accounting records, supporting documents and business correspondence for at least 10 years from the end of the financial year. Business emails are fully covered by this requirement for business correspondence.
Breach of this obligation is punishable by a fine (Article 325 of the Swiss Criminal Code). In the event of bankruptcy, failure to retain records may result in imprisonment for up to three years (Article 166 of the Swiss Criminal Code).
Under the new Federal Data Protection Act (nLPD), which comes into force on 1 September 2023, SMEs must also ensure the protection of personal data contained in emails.

Is my SME required to archive emails?
Yes, if your SME is registered in the Commercial Register. Section 958f of the Swiss Code of Obligations requires business correspondence to be kept for 10 years.
