These Terms of Service govern the use of the MailArk email archiving service ("the Service") available at mailark.ch. By using the Service, you agree to these terms.

Service Description

MailArk is a cloud-based email archiving service that allows users to automatically archive their emails via IMAP connection. The service includes full-text search, attachment preservation and various plan options.

Registration and Account

An account with accurate information is required. You are responsible for your account security. Minimum age is 18 years.

Plans and Payments

MailArk offers: Free (with limitations), Professional (CHF 9/month) and Business (CHF 29/month). Payments are handled by Stripe monthly. You can change or cancel your plan anytime. Upon cancellation, the plan remains active until the end of the billing period. Price changes are communicated 30 days in advance by email.

Plan Limits

Each plan has specific limits for email accounts, storage and retention period. Sync automatically stops when a limit is reached. Upgrade is available anytime.

Acceptable Use

You agree to use the Service in compliance with applicable laws. Prohibited: archiving illegal content, accessing other users' accounts, intentional system overload, spam or fraudulent activities.

Data Ownership

You retain full ownership of all archived emails and data. MailArk claims no ownership rights. You can export your data at any time.

Service Availability

We strive for reliable service but cannot guarantee 100% availability. Temporary interruptions for maintenance or force majeure may occur.

Limitation of Liability

The Service is provided "as is". MailArk is not liable for: data loss due to circumstances beyond our control, indirect or consequential damages, third-party service interruptions. Maximum liability is limited to amounts paid in the preceding 12 months.

Account Deletion

You can delete your account from the Profile page. After deletion: access is revoked immediately, data is retained for 30 days then permanently deleted, active subscriptions are cancelled.

Changes to Terms

We reserve the right to modify these terms. Significant changes will be communicated 30 days in advance by email.

Governing Law

These terms are governed by Swiss law. Jurisdiction is the domicile of the service operator in Switzerland.
