Why must a trustee archive emails?
Swiss legislation imposes specific obligations regarding document retention. Article 958f of the Swiss Code of Obligations (CO) requires that accounting records, supporting documents and business correspondence be retained for 10 years from the end of the financial year.
For a fiduciary firm, emails represent a fundamental part of business correspondence: communications with clients, accounting instructions, tax documents and contracts. Losing them or being unable to retrieve them means risking penalties, problems during audits and a loss of client trust.
With the entry into force of the nLPD (new Data Protection Act) on 1 September 2023, fiduciaries must also ensure that personal data contained in emails is stored securely, with regulated access and the option to delete it when no longer required.
